2. General
These Terms and Conditions apply to all offers, purchases, repairs, and agreements with Binenbaum Antiques & Jewelry, both online and in-store.
By purchasing an item or using our services, the customer agrees to these terms.
3. Nature of antique and vintage jewelry
Most items sold are antique, vintage, or pre-owned.
Therefore:
•Normal signs of wear may be present
•Minor imperfections are part of the character and history
•Stones may show wear consistent with age
These characteristics are not considered defects.
All items are professionally inspected before sale.
Due to the nature of antique and vintage jewelry, periodic inspection and maintenance are recommended and remain the responsibility of the owner.
4. Product descriptions and authenticity
We make every effort to describe items accurately.
However:
•Stone weights are approximate unless certified
•Stone treatments may not always be known
•Colors may vary slightly due to photography and screens
All descriptions reflect our professional opinion but do not constitute a guarantee.
5. Pricing and payment
All prices include VAT where applicable.
Ownership transfers only after full payment is received.
We reserve the right to refuse or cancel orders in case of pricing errors.
6. Delivery and shipping
Items are shipped fully insured.
Risk transfers to the customer upon confirmed delivery.
Customers must inspect items immediately upon receipt.
Any shipping damage must be reported within 48 hours.
7. Right of withdrawal (online purchases)
Customers may return online purchases within 14 days of delivery, in accordance with EU law.
Conditions:
Item must be:
•unworn
•undamaged
•unmodified
•in original condition and packaging
Return shipping and insurance are the responsibility of the customer.
Refund is issued after inspection.
8. Exceptions to returns
Returns are not accepted for:
•resized rings
•custom-made jewelry
•modified items
•special orders
•repaired items
9. Satisfaction return period
We offer a 15-day return period for unused items purchased online.
This does not affect statutory rights.
10. Warranty
All items are covered by the statutory warranty as provided under Dutch law (conformity requirement).
This means that an item must conform to what the customer may reasonably expect, taking into account the nature of the item, its age, and its description.
Antique and vintage jewelry is sold as second-hand goods and may show normal signs of wear consistent with age.
Warranty covers hidden structural defects that were not visible at the time of sale and that fall outside normal wear expectations.
The following are not covered by warranty:
• normal wear and tear
• accidental damage
• improper use or handling
• loss or damage of stones due to wear, impact, or external causes
For new items, the same statutory conformity requirements apply.
No additional commercial warranty is provided unless explicitly agreed in writing.
11. Repairs and resizing
Repairs and resizing are performed at the customer’s request and risk.
Due to the nature of antique jewelry:
•complete invisibility of repair cannot be guaranteed
•structural limitations may exist
No returns are accepted after resizing or modification.
12. Consignment items
Some items are sold on behalf of third parties.
All standard conditions apply unless stated otherwise.
13. Condition acknowledgment
By purchasing, the customer acknowledges:
•the antique or vintage nature of the item
•its existing condition
•and accepts normal signs of age and wear
14. Liability
Binenbaum Antiques & Jewelry is not liable for:
•normal wear after sale
•improper use
•damage after delivery
Liability is limited to the purchase price.
15. Governing law
These terms are governed by Dutch law.
Disputes will be handled by the court in Amsterdam.
